Q) Does the new legislation affect my business?

A) The quick test is to answer this question....

"Is your organization a federal work, undertaking or business that collects, uses or discloses personal information in the course of a commercial activity?"

(If your company is subject to any part of the Canada Labour Code, it is probably a federal work, undertaking or business.)

If YES, you are subject to the Act as of January 1, 2001. It also applies to your employees' personal information as well as your customers'.

If NO:

Do you disclose personal information outside the province for consideration? In other words, is personal information the subject of the transaction?

If YES, that disclosure is subject to the Act beginning January 1, 2001.
